2. Our Products
All products offered by BVBA O'Choc on the webshop are described and depicted as completely and precisely as possible and in good faith. If, despite all our precautions, an error occurs in our webshop, BVBA O'Choc cannot be held liable for any errors. BVBA O'Choc can under no circumstances be held liable if the items offered are used incorrectly or irresponsibly by the buyer, nor in the event of material or physical damage to third parties caused by incorrect and/or illegal use of the items on this web shop.

4. The Order
There is a valid agreement between the buyer and BVBA O'Choc when BVBA O'Choc receives the confirmation of the buyer's order on its webshop. BVBA O'Choc will always send a confirmation email of the order to the buyer. BVBA O'Choc reserves the right to refuse an order or to subject it to additional conditions. By ordering on this webshop you declare to be older than 18 years and to be responsible for your purchase act.
You can pay via the Mollie payment platform.
You can pay safely and quickly with the payment method of your choice:
KBC/CBC payment button, Belfius Pay Button, Mister Cash, Ideal, Credit card, bank transfer or Paypal.
Your order will be processed and shipped immediately after confirmation of payment.
6. Transportation and Delivery
6.1. Transport costs (in €, VAT included) : We use a fixed delivery cost as follows:
- Fixed shipping cost Belgium of €5.90 | Free shipping from 50€ for 1 delivery address in the Benelux | Shipping costs for other countries can be seen on the checkout page by adjusting the country of destination.
6.2. Delivery term :
After confirmation of payment, the purchased products are shipped with the aim of delivery in the specified time and to the delivery address specified by the buyer when ordering. If the buyer orders several items, the delivery will only take place if all items are in stock. BVBA O'Choc cannot be held liable for damage resulting from a product not being in stock or a late delivery. Take into account a processing time of 2 to 3 working days if you choose payment method bank transfer. This shifts the delivery time. The payment confirmation has priority over the chosen delivery time.
Deliveries are determined by the forwarder and opening hours of BVBA O'Choc. Standard delivery is the 1st working day following the working day after the package has been shipped, between 8 am and 4 pm. During busy periods, delivery times can increase by a few working days. Contact us if you want a guaranteed delivery time.
Schedule shipments (except payment method bank transfer/bank transfer) for Belgium:
Tuesday to Ordered before 4 p.m. on Thursday = delivered the next day.
Friday or Saturday ordered before 11:30 am = delivered Monday.
Ordered on Saturday after 11.30 am or on Sunday or Monday = delivered on Wednesday.
Deviations from these anticipated delivery times are always indicated on the checkout page and order confirmation email. Deliveries abroad are 1 to 5 extra working days to be added to this date. Weekends and holidays do not count as working days.

Take into account a processing time of 2 to 3 working days if you choose payment method bank transfer. All other payment methods are confirmed automatically and immediately.
We may need more time for a large order. After all, O'Choc packs everything fresh and according to the customer's wishes. You will be contacted if the requested delivery date is not possible. You will be notified by email with your tracking number and delivery status.
6.3. Packaging and transport insurance :
The buyer is responsible for checking the goods received. The buyer must inform BVBA O'Choc of any damage within 5 working days via email at email@example.com. BVBA O'Choc reserves the right to refuse the buyer's application if this term is not respected. BVBA O'Choc will, after receipt of the notification of damage, give the buyer instructions for possible return by the buyer. BVBA O'Choc uses packaging materials to protect the products, but cannot be held liable for damage caused by transport and associated costs. The shipment is uninsured unless requested by the buyer when ordering (cost from 1€ per individual shipment: the amount of the cover depends on the value of the contents).
6.4. Delivery address :
The buyer is responsible for the completeness and correctness of the delivery address provided. Incorrect delivery addresses are the responsibility of the buyer and may lead to additional costs. In the event of errors in the address details of the addressee, BVBA O'Choc can under no circumstances be held liable for the impossibility of delivering the ordered products.
6.5. Absence of the buyer at the time of delivery :
The buyer must ensure that he is present at the time of delivery. In case of absence, a notice of absence will be left in the mailbox. Then the buyer will be able to contact the forwarder via a telephone number to make a new appointment within a maximum of 5 days.
7. Cancellation of an order
You may let us know within 14 working days of receipt of the product that you wish to cancel your purchase. The buyer can inform BVBA O'Choc of his cancellation by email at the address firstname.lastname@example.org. The goods must be returned undamaged, unopened and in the original packaging within 5 working days after this notification. The buyer must send a copy of the invoice and an accompanying letter stating your full account number (IBAN and BIC code) with your return shipment. Cancellation is not possible for goods that are specially made for you (= personalized products) and perishable goods. In case of cancellation of an order, O' Choc BVBA will refund any sums paid less the direct costs of delivery (shipping costs and order handling costs) within 30 days after acceptance of the return. The shipping costs for the return shipment are the responsibility of the buyer. O' Choc BVBA only refunds the shipping costs if the buyer did not receive the item that was ordered. email@example.com can refuse or not refund returned items if the packaging has been opened or if the products have been used or damaged by the buyer.
The buyer will only return the item after notification from BVBA O'Choc to do so. The buyer ensures sufficient postage and registered mail if the value of the shipment exceeds 50 EURO. We recommend that you use a courier service and insure the shipment. Always enclose a copy of the invoice and an accompanying letter stating your full account number (IBAN and BIC code). The buyer is responsible for the return shipping. Unstamped or insufficiently stamped shipments are always refused and returned to the sender.

9. Intellectual Property Rights
The content of this site, including brands, logos, drawings, data, product or company names, texts, images, etc., are protected by intellectual rights and belong to BVBA O'Choc or entitled third parties.
Disputes concerning the conclusion, validity, interpretation or execution of the sales contract or the current general terms and conditions are exclusively governed by Belgian law and fall under the exclusive jurisdiction of the Courts of the District of Ghent.
